Acceptance of These Terms of Service
Welcome to StarQuiz AI (“StarQuiz,” “we,” “us,” or “our”). By accessing, browsing, or using our services provided through our website, applications, or related technologies (collectively referred to as the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.
StarQuiz reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting, and we will update the “Last Updated” date at the top of this document. For material changes, we may also notify you via email, the Service interface, or other reasonable communication methods. By continuing to use the Service after any updates, you accept and agree to the revised Terms.
We encourage you to periodically review these Terms to stay informed of any changes. If you do not agree to the updated Terms, you must stop using the Service.
Your Privacy and Student Data
At StarQuiz, your privacy is a top priority. Our Privacy Policy outlines how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.
We comply with major privacy regulations, including FERPA (Family Educational Rights and Privacy Act), COPPA (Children’s Online Privacy Protection Act), and other applicable state and federal laws governing data protection.
StarQuiz as Data Processor / Service Provider
StarQuiz processes student data solely to provide educational services on behalf of the school or teacher. We do not sell student data. We do not use student data for marketing. We do not build behavioral profiles unrelated to education.
The relationship between StarQuiz and the educational institution (School or District) is that of a Service Provider or Data Processor, acting solely at the direction and on behalf of the institution (the Data Controller). The full terms governing the processing of Student Data are detailed in our separate Data Privacy Addendum (DPA), which is incorporated into these Terms and mandatory for all educational institutions.
Eligibility and Service Overview
Eligibility
By using the Service, you confirm that you are:
At least 18 years old, or a minor with parental/guardian or school authorization.
Using the Service for educational purposes or personal use in compliance with these Terms.
StarQuiz AI is a teacher-guided, AI-powered assessment platform designed to enhance student learning outcomes through features like automated quiz generation, personalized feedback, and data-driven insights.
The Service supports various educational use cases, including:
Formative Assessments: Real-time quizzes based on uploaded lesson materials or recorded lectures.
Exit Tickets: Quick evaluations at the end of class to assess student understanding.
Homework Assignments: Low-stakes assessments with detailed feedback for student learning.
Bulk Quiz Creation: Efficiently generate quiz banks and exam questions by uploading batch materials.
User Registration and Accounts
Registration Requirements
To access certain features of the Service, you may need to create an account. By registering, you agree to:
Provide accurate, complete, and current information during registration.
Keep your account information updated to maintain its accuracy.
Account Security
You are responsible for safeguarding your account credentials, including your password. You agree to notify us immediately if you suspect any unauthorized use of your account or breach of security. StarQuiz is not liable for any losses or damages arising from unauthorized access to your account due to your failure to protect your credentials.
School and Teacher Responsibilities
Schools and Teachers who create accounts on behalf of students represent that they have obtained all necessary parental or institutional consents required by law. They are responsible for:
Obtaining all necessary consents, authorizations, and notices required under applicable law (including FERPA and COPPA) before providing student data to StarQuiz.
Managing student accounts and data, and ensuring its accuracy.
Facilitating the handling of student and parent requests to access, review, amend, or delete Student Data as required by FERPA.
Access and Use of the Service
License Grant
Subject to these Terms, StarQuiz grants you a non-exclusive, non-transferable, revocable license to access and use the Service for personal, educational, or non-commercial purposes.
Prohibited Activities
You agree not to:
Use the Service for any illegal or unauthorized purpose.
Upload content that is harmful, obscene, defamatory, or infringes on the intellectual property rights of others.
Engage in data mining, scraping, or similar data extraction practices.
Circumvent, disable, or interfere with security-related features of the Service.
Share, distribute, or commercialize any Service content without express authorization.
Violation of these rules may result in account suspension, termination, or legal action.
Ownership
StarQuiz retains all ownership rights to the Service, including its software, design, content, and branding.
User-Generated Content
Teachers retain ownership of assignments and materials uploaded to the Service. By uploading content, you grant StarQuiz a limited, non-exclusive license to use, store, and display the materials solely to provide the Service (e.g., generating quizzes, storing materials, scoring, or enabling classroom use). You represent that you have the rights necessary to upload the content you provide.
Third-Party Services and Integrations
The Service may include links to or integrations with third-party platforms (e.g., learning management systems). StarQuiz is not responsible for the accuracy, privacy practices, or availability of these services. Use of third-party platforms is subject to their terms and policies.
Payments
If you purchase a paid plan, you authorize us (and our payment processor, Stripe, Inc.) to charge the applicable fees.
Disclaimer, Indemnification, and Limitation of Liability
Indemnification
You agree to indemnify and hold StarQuiz, its affiliates, and employees harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE.” We make no warranties regarding the Service’s availability, accuracy, or suitability for your purposes. Use of the Service is at your own risk.
Limitation of Liability
To the extent permitted by law, StarQuiz is not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or interruptions. Total liability shall not exceed the greater of $100 or the fees paid in the last six months.
Termination
We may suspend or terminate your account for any violation of these Terms or misuse of the Service. Upon termination, your access will immediately cease, and your data may be deleted.
Dispute Resolution
Agreement to Arbitrate
All disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). By agreeing to these Terms, you waive the right to a trial by jury or class action.
Governing Law
These Terms are governed by the laws of Delaware, without regard to its conflict of law principles. Any disputes not subject to arbitration will be resolved exclusively in the state or federal courts located in Delaware.
